Standard Regulatory & Legal Notice:
This document sets out the mandatory terms under which Markdex permits access to its spaced repetition architecture, algorithm schematics, custom CSS templates, and knowledge systems. These terms operate under the laws of England and Wales.
1. Subject Matter and Acceptance of Agreement
These Terms of Service ("Terms", "Agreement") constitute a legally binding contract entered into by and between the user ("you", "your", or "User") and Markdex ("we", "us", or "our"), governing your access to and use of our website, documentation, interval calculations, template designs, and educational resources regarding spaced repetition software.
By accessing, browsing, downloading card syntax, copying interval configuration parameters, or otherwise interacting with our platform, you acknowledge that you have read, understood, and unequivocally agree to be bound by these Terms, as well as our Privacy Policy and Cookie Policy. If you do not agree to these terms in their entirety, you must immediately terminate access to this site.
2. Description of Educational Services and Materials
Markdex provides analytical breakdowns, configuration scripts, card templates, algorithmic interval tuning guides (such as FSRS and SM-2 implementations), and taxonomic organizational blueprints designed for learning optimization. All guides found across modules such as Interval Scheduling Calculations, Card Template Architecture, and Add-on Infrastructure are offered strictly for educational and informational development.
Markdex is an independent research and learning hub. We are neither affiliated with, endorsed by, nor a subsidiary of the official Anki software project (Damien Elmes) or any associated third-party developers, unless expressly stated otherwise in writing.
3. Acceptable Use Policy and Prohibited Operations
You agree to use our digital assets solely for lawful, non-commercial educational purposes or individual skill enhancement. In connecting to our infrastructure, you expressly agree not to:
- Engage in automated data extraction, web scraping, spidering, or bulk harvesting of our template libraries or proprietary code tutorials without written consent;
- Deploy malicious code, script injections, or denial-of-service payloads against our host servers and delivery networks;
- Redistribute, sub-license, package into paid derivative masterclasses, or resell whole modules of our documentation without attribution and explicit authorization;
- Bypass, reverse engineer, or attempt to disable security barriers, headers, or API rate-limiting measures implemented across Markdex domains;
- Misrepresent your identity, impersonate Markdex staff or contributors, or falsely claim sponsorship or accreditation from our team.
4. Intellectual Property and Card Template Syntax Rights
All text, pedagogical layouts, graphics, branding elements, taxonomic schemas, UI/UX configurations, and editorial compilations hosted on this site are the exclusive intellectual property of Markdex and are protected under the Copyright, Designs and Patents Act 1988 (UK), international copyright conventions, and relevant treaty frameworks.
Users are granted a limited, revocable, non-exclusive, non-transferable licence to implement card CSS stylesheets, HTML frameworks, and scheduling presets into their private flashcard databases for personal, academic, or internal non-distributive study workflows.
5. Disclaimer of Warranties
Express Exclusion of Guarantees
The services, scripts, calculations, and materials provided by Markdex are delivered strictly on an "AS IS" and "AS AVAILABLE" basis without warranty of any kind, whether express, implied, statutory, or collateral.
To the maximum extent permissible under applicable United Kingdom legislation, Markdex explicitly disclaims all warranties, including but not limited to implied warranties of satisfactory quality, fitness for a particular academic or professional purpose, non-infringement, software compatibility, data integrity during deck synchronisation, or uninterrupted site availability. We do not guarantee specific examination results, memory retention rates, or error-free script execution in third-party software environments.
6. Limitation of Liability
Nothing in these Terms shall exclude or restrict Markdex’s liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other statutory liability that cannot be excluded under the laws of England and Wales (including the Consumer Rights Act 2015).
Subject to the above, Markdex, its directors, employees, affiliates, and licensors shall not be held liable in contract, tort (including negligence), breach of statutory duty, or otherwise for any indirect, special, incidental, consequential, or punitive damages. This includes, without limitation:
- Loss of flashcard database records, corrupted media files, or synchronization failure;
- Loss of academic standing, missed examination thresholds, or career advancement opportunities;
- Loss of profits, business revenue, data, goodwill, or commercial opportunities;
- System outages, browser incompatibilities, or third-party add-on conflicts.
In all circumstances, our cumulative total liability arising out of or in connection with your use of the website shall not exceed the amount paid by you to Markdex in the twelve (12) months preceding the claim, or £50.00 GBP, whichever is lower.
7. External Third-Party Add-ons and Hyperlinks
Our guides contain analytical references and hyperlinks to third-party software repositories, Python extensions, and open-source add-ons (detailed in our Add-on Integration section). Markdex exercises no direct operational control over third-party scripts, repositories, or external services. We accept no liability or responsibility for damages, data corruption, or privacy breaches resulting from third-party software execution on your local hardware.
8. Amendments, Severability, and Termination
We reserve the unilateral right to update, modify, or replace any portion of these Terms at our discretion. Significant revisions will be communicated through updated revision dates at the head of this document. Your continued engagement with Markdex following the posting of amendments confirms constructive acceptance of those alterations.
If any provision of these Terms is deemed unlawful, invalid, or unenforceable by a court of competent jurisdiction in England and Wales, that specific clause shall be severed without invalidating the enforceability of all remaining provisions.
9. Governing Law and Exclusive Jurisdiction
These Terms, their subject matter, formation, and any non-contractual disputes or claims arising out of or in connection with them shall be governed by, construed, and interpreted in accordance with the substantive laws of England and Wales.
Both you and Markdex irrevocably agree that the courts of England and Wales, specifically including the competent courts sitting in Manchester, United Kingdom, shall have exclusive jurisdiction to settle any dispute, controversy, or claim arising under or relating to this Agreement, subject to any mandatory non-waivable statutory rights granted to consumers residing in other regions of the United Kingdom.
